Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to the hazard of being struck by,
and crushed by, a
citrus loader, which has an obstructed view to the rear, when the citrus
loader is operated in the
reverse direction:
a)  Harrell Grove - A Petersen Loader, #207, was being operated in reverse
gear with a broken
side view mirror adjustment, which decreased the operator's ability to
check for pickers in the
vicinity of the rear of the loader, in addition, the mirror was too dirty
to reflect images, on or
about 1/31/03.
Among others, one feasible and acceptable abatement method to correct this
hazard would be
to repair and clean the side view mirror on the right (passenger) side of
the vehicle, or backing
up the vehicle only when an observer signals that it is safe to do so.
