A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that the employer did not ensure that powered industrial trucks were equipped with operator restraint devices, including seat belts, to be used during the operation of such trucks in accordance with the American National Standards Institute (ANSI) B56.1, consensus Safety Standards for Powered Industrial Trucks, and the American Society for Mechanical Engineers (ASME) B56.1-2000 consensus Safety Standards for Low Lift and High Lift Industrial Trucks, to protect the operator in the event of a rollover: a) 9828 North 19th Avenue, Phoenix, AZ 85021: The employer did not ensure that a Yale Forklift, Model 2005-GLC030CDNUAE083, Serial Number N473636 was equipped with an operator restraint device (i.e., seat belt) to stabilize and protect the operator in the event of a rollover:
