Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to struck by/caught by hazards:
(a)Maxey Truck & Trailer & 2220 East Lincoln Ave., Fort Collins, CO:  On
or before June 30, 2003, the exposing employer did not ensure that
employees
operating powered industrial trucks (forklifts) were provided with personal
restraint devices (seat belts) during vehicle operation.  This condition
exposed
employees to struck by/caught by hazards with ejection from a Clark, Datsun
and/or Hyster forklifts that were used in the shop yard and shop facility.
Among other methods, one feasible and acceptable abatement method to
correct is to:
(a)Install/reinstall and train/retrain employees in accordance with
ASME/ANSI
B56.1-1993 Safety Standard for Low and High Lift Trucks.
Abatement Note: Abatement certification and documentation are required for
this item (see
enclosed "Sample Abatement-Certification Letter".)
