Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazards:
Worksite:  Employees were on an open sided wooden work platform elevated
by a Terex Rough
Terrain forklift truck.
Among other methods one feasible and acceptable abatement method is to do
the following:
Determine if there is another practical way to do the work. If the rough
terrain forklift truck
must be used to lift people comply with applicable provisions of American
National Standards
Institute Standard ANSI B56.6, "Safety Standard for Rough Terrain forklift
trucks".
Section 8.25 of ANSI B56.6 has design requirements for the personnel
platform.
The platform
must have a width less than the overall width of the truck (measured
across the load bearing tires
plus 10 inches on either side). The platform must have a nameplate listing
the maximum work
load including personnel and equipment as well as the weight of the empty
platform. There must
be a means to securely attach the platform to the lifting mechanism. The
platform must have
properly designed guardrails on all open sides or properly designed
attaching points for body
belts and lanyards. The platform must be designed with a structural safety
factor of not less than
2 to 1.
Section 5.15 of ANSI B56.6 has rules that operators must follow when using
a platform. The
platform must be securely attached to the lifting carriage of the
forklift. The combined weight
of the platform, load, and personnel must not exceed one-third of the
capacity listed in the load
rating chart. Personnel must remain on the platform floor unless secured
by a body belt and
lanyard.
