Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:
(a)West-bound I-84 Emerald to Curtis Project:  The hazard of being thrown
and
crushed, while loading and unloading the Case 480LL Model 40480D Product
Identification Number 90808278 backhoe on and off the two axle trailer that
was approximately 3 feet in height.
(b)West-bound I-84 Emerald to Curtis Project:  The hazard of being thrown
and
crushed, while operating the Case 480LL Model 40480D Product Identification
Number 90808278 backhoe equipped with a harley rock rake on a 7 to 1
slope.
NOTES:
(1)Among others one feasible and acceptable abatement methods to correct
this
hazard is to install a seatbelt and require its use.
(2)Abatement certification or documentation is NOT required for this item.
