Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to unmarked services including but not limited to
natural gas:
(a) Israel Synagogue, Corner of Latah and Alpine: On September 02, 2003,
the
creating employer MEL'S Locating Service, Co. failed to properly locate a
joint
utility service; therefore, exposing employees of ORIUS Dasco Division the
hazard of
explosion, while installing a power pole.
Among other methods, one feasible and acceptable abatement method to
correct
this
hazard is to:
1) Implement a training and progressive disciplinary   policy to ensure
employees
accurately  locate underground utilities.
2) Develop specific protocol for located under ground utilities.
3) Follow NULCA (National Utility Locating Contractors Association)
recommended
marking guidelines for underground utilities.
