General-duty citation text

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazard(s) that
were causing or were likely to
cause death or serious physical harm to employee(s) in that employee(s)
were exposed to the potential of
falling load(s), hoist(s), and/or supporting structure(s):
a)  Maintenance Shop -- a Budget two-ton (2T) hand-operated hook chain
hoist and a Yale one-ton
(1T) hand-operated hook chain hoist were attached by chain to rails which
were laid across the
building structure.  Chains were looped over the rails and bolted; loops
were formed in the lower end
of the chain and secured with bolts, and the hoists were hooked into these
loops.  The hoists were
used to lift powered industrial trucks for repair.  There was no knowledge
as
to the support capability
of the structure, chains, or bolts, on or about 10/8/03.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to
ensure the supporting structure has a load rating at least equal to that
of the hoists, and that the hoists
are installed in a manner suitable for the conditions encountered.
Periodic inspections should include a
careful examination of the supporting structure for its continued ability
to support the imposed loads.
Abatement certification required within 10 days after abatement date.  The
certification shall include a
statement that abatement is complete, the date and method of abatement,
and state that employees and
their representatives were informed of this abatement.
