Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
Receive injuries due to that at the time of inspection at the
establishment, Vaccination
Program building, where the premises used in whole or in part as a place
of employment
for the employees of Department of Health, did not comply with all the
occupational
safety and health regulations issued pursuant to this act; in that
employees were exposed
to the following hazards:
1. Falling water and paint debris due to water filtrations from ceiling
structure fisures.
2. Electrical contact hazards due to the wetting of lights electrical
wiring from water
filtrations.
3. Fugitive dust and paint flakes particles due to unsealed concrete walls
and ceiling
fisures.
Among other methods, one feasible and acceptabble abatement method to
correct these
hazards is to:
a. Make the appropiated repairs accordingly and expeditious to walls and
ceiling and seal
the roof,and/or
b. Relocated employees to a place free from these and other recognized
hazards.
Recibir lesiones debido a que al momento de la inspeccion en
establecimiento,
edificio
del Programa de Vacunacion donde premisas usadas todo o en parte como un
sitio de
empleo para empleados del Departamento de Salud, no cumplio con todas las
regulaciones de seguridad y salud emitidas en acuerdo a esta ley; en que
los empleados
estaban expuestos a los siguientes riesgos:
1. Caida de agua y residuos de particulado de pintura debido a
filtraciones por fisuras
en el techo.
2. Contactos electricos debido a alambrado de luces mojado por
filtraciones de agua.
3. Particulas de polvo y pintura fugitivas debido a fisuras abiertas en
paredes y techo de
concreto.
Entre otros metodos, un metodo aceptable y factible para corregir este
riesgo es:
a. Hacer las reparaciones requeridas y en forma expedita a paredes y techo
e
impermeabilizar el techo; y/o
b. Reubicar los empleados a un area que este libre de estos y otros
riesgos reconocidos.
