furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of falling to a lower level when working from
the elevated bucket
of a backhoe:
a)Site - Employee was observed working from the bucket of a Model 416C
Caterpillar backhoe with front bucket approximately 6-7' above the ground
without fall protection, on or about 9/10/03;
b)Site - Employee was observed working from the bucket of a Model 416C
Caterpillar backhoe with front bucket approximately 12' above the ground
without fall protection, on or about 9/24/03.
"ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG
OTHERS, TO CORRECT THIS HAZARD IS:
1.Train employees in the proper use of equipment and
not allow them to use the front or rear bucket as a
work platform;
2.Require employees to use appropriate equipment,
such as but not limited to: ladders, scaffold
systems, aerial lifts, for elevating employees to the
required work level."
NOTE:    IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS
REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.
FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00
AS PER 29 CFR 1903.19.
