Public Law 91-596 Section 5(a)(1) of the Occupational Safety and Health
Act of 1970: The
employer did not furnish a place of employment which was free from
recognized hazards that
were likely to cause death or serious physical harm to employees in that
employee
was riding
the trailer hitch weldment at the rear of a pick-up truck while in transit.
Algonquin, IL. Jobsite - Employee mounted the rear trailer hitch weldment
of a pick-up truck
that was in transit and being followed by a concrete truck.
Among feasible means of abatement is to follow guidelines outlined in
Illinois Traffic Code 625
ILCS 5/11-503 Section 18B forbidding reckless driving while operating
commercial vehicles.
In this instance employees should be riding in the cab of the truck.
