Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:

El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
At the bin 12 of the warehouse, employees were looking the spaces of the
rack on the forklift
truck; trademark Hyster, Model R30FF at 13 feet and 2 inches of height
above the floor.  One
of the employees was traveling over the merchandise car that was sustained
for the forks.  The
employer permited that the employee worked over the merchandise car that
is
not a safety
platform to lifting employees.  The employer did not have permission of
the manufacturer to use
this merchandise car with the forklift.  Employer did not provided fall
protection system to the
employee.  The rail of the bin were loose and when the forklift collided
the employees were
falling to the floor.
Hazard: Falls.
Among other correction methods, some feasible and acceptable methods to
correct this hazard
are providing a safety platform to the lifting carriage or change the
forklift truck.
En el "bin" 12 del almacen, empleados estaban mirando los espacios que
habia en el estante en
un montacargas marca Hyster, Modelo R30FF a 13 pies y 2 pulgadas de altura
desde el nivel
del piso.  Uno de los empleados estaba viajando sobre el carreton de
mercancia que estaba
sostenido por las horquillas.  El patrono permitio que el empleado
trabajara
sobre este carreton
que no es una plataforma de seguridad para levantar empleados.  El patrono
no tenia permiso
del manufacturero para usar el carreton con el montacargas.  El patrono no
proveyo al empleado
un sistema de proteccion contra caidas.  Los rieles del "bin" estaban
sueltos y cuando el
montacargas choco los empleados cayeron al piso.
Riesgo: Caidas.
Entre otros medios de correccion, varios metodos factibles y aceptables
para corregir este riesgo
es proveer una plataforma de seguridad para el transporte de carga o
cambiar el montacargas.
