Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to multiple injuries or death from a collapsing hoist due in part from lifting loads beyond the maximum rated load. The one-ton overhead hoists were not inspected or used in accordance with the American Society of Mechanical Engineers (ASME) and the American National Standard Institute (ANSI) B30.16- 1981 standard for overhead hoists. There was no inspection procedures in place for the overhead hoists and paragraphs 16-2.1.2 and 16-2.1.2 required the employer to conduct both frequent and periodic inspections of the overhead hoists. The employer did not ensure that the overhead hoists were used properly by not exceeding the rated capacity on the hoist. Paragraph 16-3.1.2 (h) states that the operator shall not pick up a load beyond the rated load appearing on the hoist, except during properly authorized tests. a) The employer did not ensure that monthly inspections of the hoist chains, for each hoist, was completed. Documentation was not available. b) The employer did not ensure that periodic inspections of the hoist chains was completed within the past 12 months. Documentation was not available. c) The employer utilized either the Yale or the Coffing one-ton hoists, to periodically move and turn part number 02830-00 (the largest hydraulic tank which weighed 2772 pounds) and exceeding the maximum rated load of the cranes. Among other methods, feasible and acceptable means to correct these hazards are to use a safer alternate method such as the use of an overhead hoist or crane, with a higher rated load capacity, approved by the manufacturer, which meets the requirements of ASME/ANSI B30.16- 1981. The employer can utilize the periodic and frequent inspection instructions and forms located in the manufacturer's manual. Abatement Certification and Abatement Documentation required.
