Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards associated with pinchpoints created by the
ascent and descent of
inclined lifts:
Dept. 2000:
1)The gate on the second floor for the inclined lift did not prevent
employees from
reaching over or around or through the gate while the platform was in
motion.
2)The gate on the first floor for the inclined lift did not prevent
employees from reaching
over through or around the gate while the platform is in motion.
One method to comply is to install expanded metal to close the openings in
the guard rail system
and to raise the height of the railings if necessary.
