Section 40.1-51.1(a) of the Code of Virginia: The employer, Winchester Cold Storage Co. Inc., did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were allowed to ride freight elevators where they were exposed to pinch points created when the elevator car passes a floor level. In five freight elevators on site, the operator, freight handler, and other passengers are exposed to pinch points created when the elevator car passes by the building floors and hoist-way openings when the elevator ascends. No door or gate was provided to keep employees extremities from being caught in these pinch points. The American Society of Mechanical Engineers A17.1-1990, Safety Code for Elevators and Escalators Rule 204.4a Passenger and Freight Car Doors and Gates, General Requirements states: "A door or gate shall be provided at each car entrance." One feasible method of abatement would be to install doors or gates on all elevator car entrances. Note: another feasible means of eliminating employee exposure would be to relocate the operator control switch (dead man switch) to the middle of the car wall. The operator would be protected by distance from the pinch points, since the car would stop if the operator released the switch. If this abatement method is used, the prohibition of passengers other than the operator must be enforced.
