Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were likely to cause death or serious physical harm to employees in that
employees were
exposed to falls of approximately 30 feet to the concrete street below:
a)Location: 3rd floor window ledge at 201 West 34th Street NY, NY, 10001.
Window washer on the 3rd floor window ledge had no fall protection exposing
him to a fall of approximately 30 feet to the concrete street below, on or
about
10/16/03.
Among other methods, one feasible and acceptable method of abatement is to
provide window
washers with fall protection devices such as harnesses attached to fixed
anchors, as referenced
in ANSI IWCA I-14.1-2001, Sections 3.8 and 9.2.
