Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees, in that
employees were exposed to fall hazards and struck by hazards while
operating a boom truck
with a defective boom brake held in place with a flexible strap (bungee
cord).  All unsafe
items on vehicle-mounted elevating and rotating aerial devices shall be
replaced according to
ANSI standard A92.2-1990, section 8.2.4.
(a)Caron Management, LLC 202 Water St. Eau Claire, WI:  Employees were
exposed to fall hazards of approximately 15 feet while operating an
elevated
boom with the boom brake held in place with a bungee cord, which was tied
to a hydraulic line.  This was inconsistent with the manufacturer's
specifications and caused the boom to fall with an operator in the basket.
Abatement Note:  One feasible method of abatement would be to repair the
brake
to meet
manufacturer's specifications.
