Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees employmnent and a place of employment
which were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to:
Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer shall
furnish to each of his employees employment and a place of employment
which are free from
recognized hazards that are causing or likely to cause death or serious
physical harm to his
employees in that employees were exposed to falling from a moving vehicle
and be struck by
or run over by equipment being towed.
(a) 3370 Ferncliff Place NE, Landscaping Operation - Employees were
standing on the
back of a moving flat bed truck loaded with straw, and towing a piece of
equipment
without a fall arrest system or any method or means of restraining
employees to keep
them from falling. Employees were exposed to hazards of a fall and being
struck or
crushed by equipment, on or about 04/29/04.
Among other methods, one feasible and acceptable method to correct this
hazard is:
(a) Procure and install on the sides and end of the truck bed, either a
guard rail system,
fall arrest system or similar restraining system to be used during this
operation to protect
employees from falling from a moving vehicle.
