Section 5(a)(1) of the Occupational safety and Health Act of 1970:  the
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees:
a. On or about February 23, 2004 - at the above addressed jobsite, an
employee performing
water main installation in a trench was exposed to the hazard of being
struck by the bucket of
the CAT 235C hydraulic excavator.  One feasible and acceptable abatement
method, among
others, to correct this hazard would be to follow the Construction
Industry Manufacturers
Association (CIMA) and the Equipment Manufacturers Institute (EMI) manuals
on hydraulic
excavators, which instruct operators to make sure the areas are clear of
all persons before
operating.
