Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
Crowley Dock, F/V Rebecca Irene:  On or about July 25, 2010, and at times
prior thereto, the
employer did not ensure that employees utilized the seatbelt provided on
Daewoo Model# G30P-
3, Serial# HSSD370211 forklifts.  This condition exposed employees to
struck-by and caught-
between hazards when the forklift tipped over.
Among other methods, one feasible and acceptable method to correct the
hazard would be to
enforce seatbelt use provided on the forklift.
