Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish a place of employment which was free from recognized hazards that
were causing or
likely to cause death or serious physical harm to employees in that
employees were exposed
to caught in-between hazards:
(a)Tree Specialists Inc. 149 Weld County Road #27, Brighton, CO 80601:  On
or
before 9/8/04, the employer did not ensure that seatbelts were installed
and used on
the Allis Chalmers forklift (plate and serial number not available).
Condition exposed
employee to the hazards of being caught in-between the forklift and other
stationary
objects.
Abatement Note:  Abatement certification is required for this item (See
enclosed "Sample
Abatement-Certification Letter").
Among other methods, the consensus standard ASME B56.1 - 2000 requires
that
powered
industrial trucks must have a restraint device, system, or enclosure to
assist the operator in
reducing the risk of entrapment between the forklift and the ground.
