General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following condition(s): a) Employees performing grounds work along side of the roadway were not provided with reflective warning garments to protect against the hazard posed by the passing motor vehicles as described in Part VI of the Manual on Uniform Traffic Control (MUTCD), Millennium Edition, December 2000, Section 6D.02 Worker Considerations, SubSection (B), which states, "Worker Clothing - workers close to the motor vehicle traveled way should wear bright highly visible clothing (see Section 6E.02)." Among other methods, acceptable abatement methods to correct this hazard are to provide employees with highly visible garments as described in the MUTCD, Section 6E.02 (i.e. orange, yellow, yellow-green, or a fluorescent version of these colors) and to provide training on how to work next to motor vehicle traffic in a way that minimizes their vulnerability.
