Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were from recognized hazards that were causing or likely cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from a bucket of Daewoo 400V Wheel Loader: A).On or about 10/27/08, At Tallman Island Sewage Treatment plant, College Point NY An employee was riding on a bucket of Daewoo 400V Wheel Loader, exposed to a hazard of falling approximately 10 ft. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO: 1). Follow the Daewoo Wheel Loader "Operation & Maintenance Manual" that comes with this equipment. Page 1-17 "Never allow anyone to ride on any part of machine or attachment, including any part of operator's cab". 2). Train all employees on the specific requirement associated with the wheel loader use and the appropriate warning and cautions associated with known and/or suspected hazards when they will be working around the machine. ABATEMENT VERIFICATION IS NOT REQUIRED.
