Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries and/or death: On or about: 02/09/05 Location: Lot 17, Hammond Ridge Development, Armonk, NY a) Employees walking-up/raising a pre-constructed wood frame wall, 14'9" long by 10'2" high to the vertical position, were exposed to being struck by the wall when inadequate bracing used to foot the wall failed allowing the base of the wall to kick-out and fall on the employees. Abatement Note: Among other methods, feasible and acceptable methods to abate this hazard are a) Use of more substantial bracing and backing that is capable of sustaining the load and pressures imposed during the manual raising of the wall. b) Use of a crane or other equipment having adequate capacity to raise the pre-constructed wall into position. NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
