Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY THE LOAD: a)Throughout the facility, on or about 3/10/05: The following Dayton and CM hoist support structures had an unknown load capacity rating: 1) Gluten Free Room, two hoist support structure. 2) Haysen/Triangle Machine, two hoist support structure. 3) Production Matrix/Auger, three hoist support structure. 4) Clybourne Machine, two hoist support structure. 5) Free Standing hoist support structure. Among other methods, one feasible method of abatement is to inspect the support structures for the hoists as per ASME B30.16-1993, to ensure the structure is designed to withstand the loads and forces imposed by the hoist for the rated load. b)Throughout the facility, on or about 3/10/05: Below the hook lifting devices in the following locations are used to lift bags of bulk dry food products and had no load capacity rating. 1) Gluten Free Room, two below the hook lifting devices. 2) Haysen/Triangle Machine, two below the hook lifting devices. 3) Production Matrix/Auger, three below the hook lifting devices. 4) Clybourne Machine, two below the hook lifting devices. 5) Free Standing Hoist, one below the hook lifting device. Among other methods, one feasible method of abatement is to determine the rated load capacity and mark the lifting device accordingly as per ASME B30.20-1993. c)At the facility, on or about 3/10/05: The following hoists were not being inspected on a frequent and periodic basis: 1) Gluten Free Room, two Dayton hoists. 2) Haysen/Triangle Machine, two Dayton hoists. 3) Production Matrix/Auger, three Dayton hoists. 4) Clybourne Machine, two Dayton hoists. 5) Free Standing Hoist structure, one CM hoist. Among other methods, one feasible method of abatement is to conduct frequent and periodic inspections of the hoists for wear, deterioration and malfunction as per ASME B30.16-1993 Abatement certification must be submitted for this item.
