Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to serious crushing bodily injuries or death:
Work Site: The "Leaf Vacuum Truck" was not equipped with a "reverse signal
alarm(s)" audible
above the surrounding noise level, nor was an observer used when backing
the vehicle to assist
the driver and warn employees working in and around the area prior to
backing up the truck.
On November 1, 2004, an employee was run over by the "Leaf Vacuum Truck"
and sustained
fatal injuries.
