Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: A struck by hazard when the employee operating an all
terrain forklift was not
wearing a seat belt. IAW with ASME B56.1-1993 Safety and Health Standard
for Low Lift and
High Lift Trucks, requires the manufacturers to provide, and operators to
wear operator restraint
systems.
On December 6, 2005 at 2910 N. Decatur Road, Decatur, Georgia: The
operator of the JLG
All-Terrain forklift was not wearing the manufacturer's installed seat
belt while operating the
truck over rough terrain.
One feasible means of abatement is to train all employees on the proper
way to safely operate
an All Terrain Forklift and to enforce the wearing of seat belts as
prescribed
by the
manufacturer's recommendations.
