North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employmnent and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a)jobsite, employee working from a raised forklift. The
employer did not take measures to protect employees from
being exposed to a 20' fall hazard.
NOTE: Among other methods, one feasible and acceptable method to
abate this hazard is to:
1. Construct a platform in accordance with ANSI B56.6 and ANSI
B56.1.
2. Equip employees with fall protection systems as outlined in
29 CFR 1926 Subpart M, Fall Protection.
3. Work from an aerial lift with fall protection meeting the
requirements of 29 CFR Subpart M, Fall Protection.
