Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the establishment, employees were exposed to the hazards of being struck by the mower and/or caught in the point of operation where the seat-actuated deadman's controls had been by-passed on the Toro Groundsmaster 325-D, Model #30788, Serial #80963, the Toro Reelmaster 2600-D, Model #30427, Serial #80478 and the Toro Greensmaster 3100, 3 WD, Model #04354, Serial #90229. Among other feasible means of abatement, one acceptable method of abatement is to repair the seat-actuated deadman controls on the three mowers, as required by Section 3.4.2.1.3, Deadman's Control, paragraph (c) of American National Standard Safety Specifications for Power Lawn Mowers, Lawn and Garden Tractors, and Lawn Tractors, ANSI B71.1-1972.
