North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall from elevation of up to 15 feet (Ref. ASME B56.1-2000, 4.17.2(c): Whenever a truck was used to elevate personnel the required restraining means such as railings, chains, cable, body belt with lanyard or deceleration devices, etc. were not in place and properly used): a)warehouse - where an employee operated a Hyster 30, model R30XMSZ Ordermaster for dismantling metal shelving units, raising the lift to heights of 15 ft and 10 ft, a body belt and lanyard were available however the employees did not utilize them. NOTE: The operator's manual also instructs the user to always wear the tether line and belt as does a warning sign on the truck. One feasible method of abatement would be to train employees on the proper use of the lift truck and have them review the operator's manual. North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall from elevation of up to 15 feet (Ref: ASME B56.1-2000, 5.2.3: Hands and feet were placed outside the designated area, parts of the body were outside the operator compartment): a)warehouse - where an employee operated a Hyster 30, model R30XMSZ Ordermaster for dismantling metal shelving units. When at heights of 15 ft and 10 ft, the operator and another employee who rode on a pallet placed on the forks, would step off the lift truck to perform tasks while standing on the shelves. One feasible method of abatement would be to attempt to position the lift truck such that the tasks may be performed without leaving the platform. Reference: ASME B56.1-2000, Safety Standard for Low Lift and High Lift Trucks.
