Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer does not
furnish employment and a place of employment which are free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of falling from a self propelled boom supported
aerial lift with
several operating deficiencies:
(a)Jobsite, 21 Century Drive, Ambridge, PA:  The employer does not ensure
that each
employee is protected from falling from a boom supported elevating work
platform
recommendations.
To abate this specific instance and ensure compliance at all future
worksites, the employer must
ensure that boom supported aerial platforms used by employees meet the
requirements of ANSI
A92.5, which includes the requirements that boom supported elevating work
platforms have
proper markings, legible controls, and are maintained to the
manufacturer's recommendations.
Pursuant to 29 CFR 1903.19(d), the employer must provide documentation
that this violation
has been abated within 10 calendar days of the date it receives the
citation.
OR IN THE ALTERNATIVE
29 CFR 1926.453(a)(1): Aerial lifts acquired for use on or after January
22, 1973 were not
designed and constructed in conformance with the applicable requirements
of the American
National Standards for "Vehicle Mounted Elevating and Rotating Work
Platforms, "ANSI
A92.2-1969:
(a)Jobsite, 21 Century Drive, Ambridge, PA:  The employer does not ensure
that aerial lifts
acquired after January 22, 1973 were designed and constructed in
conformance with the
applicable requirements of ANSI A92.2.1969.  An example of this violation
occurred on or
about April 18, 2005 when employees used the boom supported aerial
platform, a JLG lift, to
be transported to and from the roof.  The lift had several deficiencies
including, but not limited
to: a lack of markings or warnings, illegible controls and it was not
maintained to the
manufacturer's recommendations.  To abate this specific instance and
ensure compliance at all
future worksites, the employer must ensure that each employee use a lift
that meets the
requirements of ANSI A92.5, which included the requirements that boom
supported elevating
work platforms have proper markings, legible controls, maintained to the
manufacturer's
recommendations.
Pursuant to 29 CFR 1903.19(d), the employer must provide documentation
that this specific
instance has been abated within 10 calendar days of the date it receives
the citation.
