Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer
did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to in that the caterpillar paving machine #35-044, was not
completely shut down
prior to being serviced:
(a) Location - Nabnassett St., Westford, MA:
On 11/4/04, an employee was injured when he walked between the caterpillar
35-044
paving machine that was stopped at an idle and the refueling vehicle.
Among other methods feasible and acceptable to correct this hazard
includes, but is not
limited to:
- Develop and implement a standard operating procedure for servicing
equipment
such as shutting down entirely prior to refueling.
