Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards and/or damage to property without provision of training in the safe operation of material handling equipment: At the establishment - The employer did not assure that employees who operate yard front-end loader (Clark/Michigan Model 55B) to plow parking area in winter or use to move disabled tractor trailers have been trained in the safe use of such equipment. Abatement Note: Obtain a copy of owners/operators manual for this specific piece of machinery and provide operator training that includes hands-on observation by employer for operators of equipment to demonstrate competency in its' use.
