Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to an entrapment hazard in the event of powered industrial
truck tipover:
a)  Location 5D 01 510 2A -- an operator on Toyota forklift number 303 was
not using
the seat belt, on or about 12/8/05.
b)  Location 5A 01 062 1A -- an operator on Toyota forklift number 312
cannot have
been considered as wearing the seat belt, due to it being non-functional,
on or about
12/8/05.
Among other methods, one feasible and acceptable abatement method to
correct these
hazards is to require operators to use seat belts.
Abatement certification required within 10 days after abatement date.  The
certification
shall include a statement that abatement is complete, the date and method
of abatement,
and state that employees and their representatives were informed of this
abatement.
