T.C.A. 50-3-105(1):  The employer did not furnish employment and a place
of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to:
On 12/14/2004, the employer could have ensured employee safety by
requiring heavy equipment
operators to engage, when applicable, the "lockout" lever to prevent
accidental movement of the
equipment when employees are within the danger zone.  Feasible abatement
would be but not
limited to thorough instruction during the employment phase and before
initial work assignment
and thereafter  during an annual refresher training and instructions.
