Section 5(a)(1) of the Occupational Safety and Health Act of 1970 : The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by an automobile while working under the automobile supported by a scissor jack and jack stand. a)At the facility, 417 Dahill Road, Brooklyn, NY On or about November 11, 2004 An employee was crushed by a car when the car fell off of a scissor jack and jack stand. Among other feasible methods of abatement: 1) Follow the ASME PALD-1993 requirements of Part 4 and Part 7. Part 4 Vehicle Support Stands Section 5(c) requires "Use stands in pairs. On hard level surfaces capable of sustaining the load." Part 4 Vehicle Support Stands Section 5(d) requires "Load shall be stable. Use on other than hard level surfaces may result in possible loss of load." Part 7 Mechanical Scissors Jacks Section 5(b) requires "... Use the jack for lifting the vehicle until one wheel is clear of the ground. Emergency tire changing. For other uses, the vehicle shall be supported immediately by appropriate means. Part 7 Mechanical Scissors Jacks Section 5(c) requires "Never get beneath the vehicle when it is supported by the jack." NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
