Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the 2,070lb batteries when lifted from the forklifts. (a)Marshall Durbin Companies - Battery Changing Area - On or about 01/13/05, the safety latch for the hook on the Coffing MTC Hoist used for forklift battery lifting, was bent and twisted. Among other methods, one feasible and acceptable method to correct his hazard is perform frequent inspections as referenced in the National Standards Institute (ANSI) document B30.16- 1993, Section 2.1.2.6 which requires that hook latches should be in proper operation.
