Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employee in that
employees were exposed to crushing hazards.
a) 450 New Dorp Lane, Staten Island, NY 10306. Employee was engaged in site
work for a paving operation and was exposed to the hazard of being struck
by/crushed
by  moving machinery. This resulted in the amputation of employees leg
when he was
caught between the loading bucket of a backhoe and a concrete filled post
when the
equipment slid on the icy surface and struck employee. Condition observed
by
employees and noted in NYPD Police Report on or about 12/05/05.
ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD,
AMONG OTHER MEANS, WOULD BE FOR THE COMPANY TO FOLLOW THE
RECOMMENDATIONS OUTLINED IN CASE MANUFACTURER'S OPERATING
MANUAL, PAGE 17, WHICH CAUTIONS THAT JOBSITE CONDITIONS CHANGE
ON AN HOURLY BASIS AND THAT IT IS THE  EMPLOYER'S RESPONSIBILITY
TO MONITOR SUCH CHANGES AND KEEP MACHINERY A SAFE DISTANCE
FROM EMPLOYEES. IN ADDITION, FOLLOW THE AEM (ASSOCIATION OF
EQUIPMENT MANUFACTURERS) RECOMMENDATIONS, PAGE 15, WHICH
CAUTIONS OPERATOR TO LEARN ABOUT THE CONDITIONS IN THE WORK
AREA AND TAKE PRECAUTIONS  DURING ICY CONDITIONS.
