Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
(a) On or about February 8, 2006 at the aluminum loading area of the
chemical warehouse,
at the Akzol Nobel Chemicals plant on Battleground Road, where employees
did not
follow proper operating procedures when restarting the aluminum loading
hopper (Model
400 Discharge System). Following a shutdown of the equipment, employee by
passed the
nitrogen purging cycle and manually opened the slider valves to allow
aluminum powder
into the hopper before the nitrogen purge was completed.
Among other methods,one feasible and acceptable abatement method is to
follow the established
operating outlined by Akzol Nobel, which requires the inerting of the
process
prior to loading
the aluminum powder into the hopper.
