Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer
does not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a fall hazard of approximately 11 feet while
opening and closing
the gate of the load out spout:
(A)Job Site: On March 14, 2005, and at times prior thereto, employees were
exposed to a fall hazard of approximately 11 feet while standing on the
forks
of a Clark, model C500 HY45, serial number HY355 222 2827 forklift to
open and close the gate of the load out spout.
ABATEMENT NOTE: One feasible and acceptable method of abatement, amongst
others,
install a chain on the gate so that the gate can be opened from the
ground, thereby
eliminating the need for a worker to be elevated to the level of the gate.
Note: Abatement certification is required for this item.

recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to crushing hazards while operating a powered
industrial truck
without wearing seatbelts:
(A)Job Site:  On March 14, 2005, and at times prior thereto, the Clark
forklift,
model C500 HY45, serial number  HY355 222 2827, was not equipped with a
seat belt.
ABATEMENT NOTE: One feasible and acceptable method of abatement, amongst
others,
would be to consult the forklift manufacturer to obtain a seatbelt kit.
