Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the facility, employees were not provided a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard(s) of being struck by forklift(s) in the event of an accident. Specifically, the Toyota powered industrial truck was not equipped with an appropriate seat belt. The vehicle was used to move steel beams throughout the facility. This condition exposed employees to the hazard of being struck by the forklift in the event of a tip over accident. Among other methods, one feasible and acceptable abatement method to correct this hazard is to equip the powered industrial truck with a seatbelt, train employees on the use of the seatbelt and require employees to utilize the seat belt.
