Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to a fall hazard from a six foot
fiber glass step ladder used to gain access to the cement mixer platform:
(a)Mixer Area - Employee using a six-foot portable fiber glass step
ladder, fixed in position with
re-enforcing bars to gain access to the mixer platform. The step ladder
was not locked in the
open position with the spreaders locked in the closed position.  The
employees used the top of
the step ladder as a step, on or about June 15, 2005.
Among other methods, one feasible and acceptable abatement method to
correct these hazards include,
following ANSI A14.5-2000, "American National Standard for Ladders -
Portable Reinforced Plastic- Safety
Requirements" including but not limited to using the step ladders in the
open position with the spreaders
locked in the closed position. Prohibiting the use of the top of the step
ladder
as a step.
