Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to struck by hazards:
On or about Apr 15, 2005, employee preparing to off load PVC pipe from a
flatbed trailer was
exposed to struck-by hazards. The stacked load of PVC pipe was secured in
place by nylon
straps. When the employee released the pressure from the last of the five
straps the top load of
PVC pipe fell sticking the employee. The PVC pipe that fell from the
flatbed trailer was located
at the rear of the trailer. A rachet type come along is used for applying
and releasing pressure
for the nylon tie down straps.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THE HAZARD IS:
1. Inspect load to ensure it is stable and safe before removing straps.
2.When a load is found to be unstable, use forklift or other appropriate
equipment such as
stakes in state pockets to stabilize the load during off-load.
3. Insure that all non-essential persons are out of the off-loading area,
and maintain constant
attention to assure persons do not enter into the off-loading area.
4. As recommended in National Safety Council Data Sheet 623 Rev. 95,
remove the middle
tie-down first, then the rear tie-down and finally the front tie-down.
Then remove the top
straps in the same sequence.
5. Be prepared to move under the truck if load falls.
6. Train employees on the procedures to be followed.
29 CFR 1903.19(c)(2) abatement of the above violation was verified at the
time of
inspection, no certification is required.tion
