Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Jobsite: Buccaneer Bay Road, Plattsmouth, NE 68048: The employer did not furnish employment and a place of employment which were free from recognized hazards which were causing or likely to cause death or serious physical harm in that employees were exposed to hazards associated with the operation of powered industrial trucks. (1) Untrained employees were operating a forklift. (2) Employees did not perform a safety inspection of the forklift prior to operations. (3) Employees operated a forklift that did not have non-skid foot pedals. (4) Employees operated a forklift that had been modified by drilling holes in the tines. (5) Employees operated a forklift without using seatbelts. Feasible and acceptable methods of abatement are: (1) Develop and administer a forklift training program per ANSI B56.1-602. (2) Before starting to operate the forklift, perform a safety inspection per ANSI B56.1-702 I. (3) Install non-skid foot pedals per ANSI B56.1- 423. (4) Replace forklift tines or obtain manufacturer's approval for the modification per ANSI B56.1-503. (5) Develop and enforce a seatbelt use policy. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.
