A.R.S. 23-403(A): The employer did not furnish to each of his employees
employment and a place of
employment which were free from recognized hazards that were causing or
likely to cause death or serious
physical harm to his employees in that the employer did not require
operators of powered industrial trucks to
utilize operator restraint devices (i.e., seat belts) while operating such
trucks to restrain the operator in the event
of a rollover.
(a) Pallet Wrapping Area: One (1) employee was operating a Caterpillar
powered industrial truck (i.e., forklift)
model and serial number unknown without wearing a restraining device
(i.e., seat belt).
(b) Loading Area: One (1) employee was operating a Hyster powered
industrial truck (i.e., forklift) model# H-60XM, serial# H177B10543W,
without wearing a restraining device. (i.e., seat belt).
