North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish each of his employees conditions
of employment and a
place of employment free from recognized hazards that were causing or
likely to cause death or
serious physical harm to employees in that employees were exposed to fall
from an unapproved
site-built wooden platform:
a)site - where employees of Concepcion Santos-Marino DBA Concepcion
Santos-Marino were allowed to ride in a site-built wooden platform
constructed of
oriented strand board on a 2"X4" wooden frame for a completed measurement
of
97-inches wide, 48-inches long and 48-inches tall to access the 34-foot,
6-inch
eave of the new structure.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to
use a ladder for roof access.

platform which
complies with the design requirements listed in Part III of this Standard"
b)site - where the site-built wooden platform was tied to the backrest of
an
extendible-boom forklift with a length of nylon strapping.  The manually
adjusted
forks of the forklift inserted into the platform fork positions do not
prevent side-to-side (rotational) movement.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to
use a ladder for roof access
