Section 5(a)(1) of the Occupational safety and Health Act of 1970:  the
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees:
Engine Room - On or about May 3, 2006, employee(s) were exposed to hazards
arising from
the employer's non-compliance with the prescribed safeguards of the
ANSI/ASHRAE Standard
(2004), "Safety Standard for Refrigeration Systems", or of an equivalent,
and generally accepted
standard.
Specifically:
a. Doors were not clearly marked or permanent signs posted with "ONLY
AUTHORIZED
ENTRY" at doors of engine room.
b. No signs on vessels as per NFPA or HMIS.
c. Valves and piping in ammonia service not identified or labeled.
d. All pipes piercing the interior walls were not tightly sealed to the
walls through which they
pass.
e. No visual alarm located outside each entrance of the refrigerating
machinery room.
f. No outside emergency stop.
g. Doors communicating to engine room were not self-closing,
tight-fitting, and opening
outward.
h. Walls and doors of engine room were not of at least one-hour fire
resistive construction.
