40.1-51.1(a) of the Code of Virginia: The employer, Waynesboro Alloy Works, Inc., did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were operating a Wysong 250 Ton Press Brake, a Chicago 250 Ton Press Brake and two Verson Allsteel 100 Ton Press Brakes, located in the Large Fabrication Area and the Absorber Building, which exposed them to: Amputation by not providing a cover for the foot treadle on the press brakes to prevent accidental actuation by falling or moving objects, or by someone stepping on it. One feasible and acceptable abatement method, among other methods, to correct this hazard, would be to provide a cover over the foot treadles for the press brakes such as that called for by ANSI B11.3-1982, American National Standard Safety Code for Press Brakes. During the follow-up inspection conducted on November 10, 2005, it was determined that the foot pedal guard for the Wysong 250 Ton Press Brake had been located in the Machine Shop and installed on the foot pedal. A work order had been generated for the fabrication of foot pedal covers for the remaining press brakes but had not yet been given to the Production Area for fabrication. The Abatement Verification form listed the corrective action as having been completed on September 2, 2005. Abatement had not been completed by the abatement date of October 11, 2005 nor the follow-up inspection date of November 10, 2005.ber

In the in the Large Fabrication Area and the Absorber Building, employees operate a Wysong 250 Ton Press Brake, a Chicago 250 Ton Press Brake and two Verson Allsteel 100 Ton Press Brake. Adequate point of operation guarding was not provided which could cause amputation. One feasible and acceptable abatement method, among other methods, to correct this hazard, would be to provide machine guarding for the point of operations for the press brakes such as that called for by ANSI B11.3-1982, American National Standard Safety Code for Press Brakes.
