employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that the employee was
exposed to the hazard of being crushed by the Nissan powered industrial
forklift truck in the
event of a tip over accident.

operator of the
Nissan powered industrial truck that was used to unload dock trucks. The
employee was
exposed to the hazard of being crushed by potential roll-over action of
the fork truck.
Among other methods, one feasible and acceptable method to correct this
hazard would
be to enforce the requirement that the operator of the powered industrial
truck use the
seat belt.
