Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to Being struck by falling debris: falling debris a) Fourth floor of the building located at 374 Millburn Ave.,'School House Paza', Millburn, NJ: Employees exposed to being struck by falling debris due to inadequate anchorage of the debris chute supports around the window frame while working in the debris trailer leveling the piles of debris which had been dumped. Among other methods one feasible and acceptable abatement methods are to comply with the Superchute installation manual written by the manufacturer which states in part: 1) Safer chute installations can be achieved using Superchute chute hoists namely Loadspreaders for windows. 2) If the Superchute is anchored by any other method a structural engineer must verify the adequacy of the anchors and supporting structure. Violation occurred on or about 7/28/05.
