Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck by falling cinder
block.
a)On or about August 15, 2006, and at times prior, employees were exposed
to the
hazard of falling cinder block when working in the vicinity of and walking
through a bay
door in receiving whose cinder block frame had sustained significant
damage over time.
Among others, one method of abatement to eliminate this hazard would be to
repair the
cinder block wall in the area and perform inspections of the walls to
promptly repair any
subsequent damage.
